Nottingham Forest's appeal against a points deduction from the Premier League was unsuccessful.
The East Midlands club was docked four points earlier this season for breaching the league's profit and sustainability rules.
According to The Athletic, Forest appealed the decision but an independent committee decided to uphold the original penalty.
The decision means Nuno Espiritu Santo's side move three points clear of the relegation zone with 29 points.
Luton are currently in the final relegation zone with 26 points, while Burnley are in 19th place with 24 points, two points behind.
Forest were docked points earlier this season for overspending by £34.5m over three years.
The club initially said they were “extremely frustrated by the tone and content of the Premier League's submission” following their reasoning, adding that they were “also surprised that the Premier League did not consider the club's unique situation and its mitigation measures at all”.
Forest face Chelsea at the City Ground on Saturday night. If they finish better than Luton away at West Ham United they will ensure Premier League safety, although due to goal difference they will be almost safe if they equal Luton's finish.
They then play away to Burnley in their final game of the season.
