The “Plan” comprehensively strengthens legal protection in key areas involving finance, trade, science and technology and innovation, and details 22 tasks in three areas: criminal punishment, legal supervision, and service guarantee. Based on the deployment of the Supreme People's Procuratorate's “Prosecution and Protection of Enterprises” project, the “Plan” adds a number of Shanghai-specific innovative measures to ensure the improvement of the city's capabilities. For example, the “Shanghai Intellectual Property Inspection” application was developed to complete the online integration of intellectual property “one thing”, deepen the inspection and protection of the entire chain of intellectual property, optimize and strengthen the comprehensive performance of intellectual property inspection; collaboratively improve the governance of illegal financial intermediaries Improve quality and efficiency, guide more credit funds to flow to the real economy, and smooth corporate financing channels. Deepen the compliance reform of enterprises involved in the case, promote the extension of criminal compliance from the prosecution link to the investigation link and the trial link, implement the compliance notification system for new business entities, help enterprises strengthen their own compliance construction and improve their ability to withstand risks; play a leading role and rely on The Yangtze River Delta integrates and develops the procuratorial cooperation mechanism platform, establishes and improves a unified coordination mechanism for cross-regional legal policy application standards, strengthens connection and cooperation in the handling of cases involved, and jointly maintains the business environment in the Yangtze River Delta region.
In response to the common complaints from entrepreneurs about their lack of understanding of newly released laws and regulations, enterprise-related policies issued by judicial authorities, and litigation procedures, the first issue of the “Guide to Prosecution and Protection of Enterprises” adopts a question-and-answer format to interpret enterprise-related laws. The policy focuses on the field of criminal prosecution and is divided into “Procedural Guidelines” and “Guidelines for Punishing Internal Corruption in Enterprises.” In the next step, the Shanghai Municipal Procuratorate will also continue to issue a series of guidelines on inspection-related business.
